Eligibility By utilizing our services, you confirm that: - You are at least 18 years old or legally authorized to act on behalf of your business. - You have the authority to grant access to business accounts. - All information provided is accurate. 3. No Guaranteed Results Sendera Agency provides professional marketing services but does not guarantee specific outcomes, such as: - Revenue increases - Sales volume - Subscriber growth - Conversion rates - Overall business success - Return on investment Results depend on numerous factors outside our control, including market conditions, website performance, traffic, pricing, product quality, competition, and consumer behavior. Any examples, estimates, forecasts, or testimonials are for illustrative purposes only. 4. Client Responsibilities Clients agree to: - Provide required account access promptly - Supply accurate business information - Deliver assets and materials on time - Approve work when requested - Maintain ownership of their own business accounts Sendera Agency is not responsible for delays caused by lack of access, delayed communication, or incomplete materials. 5. Account Access Clients may grant Sendera Agency limited access to business systems, which may include: - Shopify - Email marketing platforms - Analytics tools - Ecommerce systems Clients remain the owners of their accounts and data. We will never requested unnecessary access, and clients may revoke access once services conclude. 6. Payments Payment terms apply as follows: - Setup fees must be paid before work commences. - Monthly plans renew automatically unless cancelled. - Payments are due according to the selected plan. Failure to pay may result in service suspension, delayed delivery, or account closure. Prices remain subject to change for future billing periods with prior notice. 7. Refund Policy Due to the nature of digital services: - Completed work is non-refundable. - Setup work is non-refundable once implementation begins. - Monthly service periods already delivered are non-refundable. Refund exceptions may be considered at our sole discretion. 8. Delivery Timelines Delivery timelines are estimates only. Sendera Agency is not liable for delays caused by missing access, client revisions, platform outages, or issues with third-party systems. 9. Revisions Reasonable revisions may be included depending on the purchased plan. Requests outside the original project scope may require additional fees. 10. Intellectual Property Unless otherwise agreed: - Clients own their business data and customer lists. - Sendera Agency retains ownership of internal systems, processes, frameworks, and templates. Clients receive the rights to use completed deliverables for their specific business purposes. 11. Confidentiality Sendera Agency will make reasonable efforts to protect confidential client information. Clients agree not to disclose internal business methods, pricing structures, or proprietary processes belonging to us. 12. Limitation of Liability To the maximum extent permitted by law, Sendera Agency shall not be liable for lost profits, business interruptions, indirect damages, data loss, or missed opportunities. Total liability shall not exceed the amount paid for services during the preceding 30 days. 13. Third-Party Platforms Sendera Agency is not responsible for outages, policy changes, restrictions, or actions taken by third-party providers. 14. Service Refusal We reserve the right to refuse or terminate service whenever necessary.
